DEFINITIONS

In this Privacy Policy (the “Policy”) of the sole proprietorship registered with the Quebec Enterprise Register under NEQ 2281679086 and doing business as ActuMates (“ActuMates,” “we,” “our”), the following terms beginning with a capital letter have the meanings set forth below, unless the context indicates otherwise:

  • Platform” refers to the online learning and educational materials platform available on the actumates.ca website, marketed by us under the name ActuMates.
  • Personal Information ” means information that identifies an individual, directly or indirectly, excluding anonymized information and Business Contact Information, in accordance with applicable laws.
  • Business Contact Information” means information relating to the performance of a role within a company, such as a person’s name, title, and job function, as well as the address, email address, and phone number of their workplace.
  • “User ,” “Users,” and “you” refer to the individual(s) who have an individual account and use the Platform.

This Policy applies to any user of the Platform whose Personal Information is collected, disclosed, or otherwise used by ActuMates through the Platform. This Policy also describes why and how we collect, disclose, and use your Personal Information for our own purposes (please see the “Collection and Use” and “Cookies” sections for more information on this subject).

We strive to implement policies, practices, and procedures related to the management of Personal Information that we hold or have in our custody. These govern, in particular, the retention and destruction of Personal Information, the complaint handling process, and the management of confidentiality incidents.

Generally, we obtain the Personal Information we need directly from you, for example, when you create your account, make a subscription payment, or contact us via email. We may also obtain your Personal Information through cookies, as described below.

The legal basis for processing your Personal Information is generally consent, unless applicable law provides for another permissible legal basis (for example, to comply with our legal obligations, or when necessary to establish, exercise, or defend a legal claim or proceeding).

You may, if you wish, refuse the processing of your Personal Information. You may also, at any time, subject to reasonable notice and any applicable legal or contractual restrictions, withdraw your consent (if applicable) to the processing of your Personal Information by contacting us. However, please be aware that if you choose not to provide your Personal Information, this may prevent you, for example, from using the Platform, as this information is essential for accessing it. You may contact us as indicated in the “Contact Us” section to submit any requests in this regard.

ActuMates collects and uses the following information, among other things, in connection with your use of the Platform:

  • Identifying information (last name, first name, email address);
  • Information related to your account and purchases, including your order number;
  • Technical and browsing information (IP address, device type, browser, pages viewed, duration of visits);
  • Information regarding your use of the Platform;
  • Any other Personal Information provided to ActuMates by the User in connection with the use of the Platform.

The financial information you provide at the time of payment is that required by our payment solutions partner. ActuMates does not collect or store any information related to your payment card.

Here are the purposes for which ActuMates collects and uses your Personal Information in connection with the Platform:

  • To provide and manage the Platform, including your account, your subscription, and access to its features and educational materials;
  • To ensure the security of the Platform;
  • To communicate with you, including to provide you with support and respond to your requests;
  • To protect our rights and comply with our legal and regulatory obligations, including through the use of watermarks or other protective measures;
  • To send you newsletters if you have consented to receive them;
  • For any other purpose to which you consent.

We do not use automated decision-making, including profiling, for decisions that have legal effects on you.

ActuMates discloses and transfers Personal Information only when required or permitted by applicable laws. ActuMates may occasionally need to share Personal Information with its subcontractors or agents to help us make all the features of our Platform available (for example, hosting or payment service providers). These third parties will have access only to the Personal Information necessary to perform these tasks and are required not to disclose or use it for any other purpose. If we disclose Personal Information outside of Quebec, we will take appropriate measures to ensure that the information is adequately protected.

ActuMates retains Personal Information only for as long as necessary to fulfill the purposes for which it was collected, or as permitted or required by law. Once these purposes have been fulfilled, ActuMates will destroy or anonymize the Personal Information in accordance with its internal policies.

ActuMates ensures that it implements security measures appropriate to the sensitivity of the data in order to protect Personal Information from risks such as loss or theft, and unauthorized access, disclosure, copying, use, alteration, or destruction. To the extent possible and applicable, ActuMates implements and maintains contractual, technical, and administrative measures to help protect the security and confidentiality of your Personal Information. It should be noted, however, that no method of transmission over the Internet or means of electronic storage is completely secure or error-free. We therefore cannot guarantee that your Personal Information is fully protected, for example, against interference or misappropriation. You acknowledge that the security of online transactions and the security of communications sent electronically or by mail cannot be guaranteed. You provide information to us via the Internet or by mail at your own risk. We encourage you to exercise caution when using the Internet.

The Platform is not intended for minors, and we do not knowingly collect their Personal Information. However, if a parent or guardian discovers that their minor child has provided us with Personal Information, they may contact us using the contact information provided in the “Contact Us” section.

Under applicable law, you may have certain rights regarding your Personal Information, such as the right to data portability and the right to have your Personal Information de-indexed, the right to access or correct your Personal Information, the right to withdraw your consent (if applicable), the right to restrict the use of your Personal Information, as well as the right to object to such use. To exercise any of these rights (to the extent they are available), please contact us by writing to the address provided in the “Contact Us” section.

In addition, you may file a complaint with ActuMates if you are dissatisfied with how we process your Personal Information or with our compliance with this policy. The law also allows you to file a complaint with a privacy commissioner or any other competent supervisory authority responsible for the protection of Personal Information.

A cookie is a small text file that is stored in a designated location on your computer, mobile device, tablet, or other device when you use your browser to visit an online service. Other tracking technologies, such as web beacons and tracking pixels, may be used for similar purposes. In this Policy, all of these tracking technologies are collectively referred to as “Cookie(s) .” Any Personal Information collected using Cookies by ActuMates, or on its behalf, is treated with the same level of confidentiality as any other Personal Information held by ActuMates. When you use our Platform, we will use strictly necessary Cookies. These Cookies are essential to the Platform’s operation and cannot be disabled in our systems. Strictly necessary Cookies must be present for the Platform to provide basic functions; they may include login functionality and allow you to navigate from one page to another without losing previous actions within the same session.

The Platform may contain hyperlinks to external sites that take you away from the Platform (the “External Site(s)”). You acknowledge and agree that ActuMates is not responsible for the availability of these External Sites or for the accuracy of the content, products, or services available on these External Sites. Hyperlinks to External Sites do not imply that ActuMates endorses or approves of such External Sites. You acknowledge and agree that you assume all risks arising from your use of External Sites. By using the Platform, you expressly release ActuMates from any liability arising from your use of any External Site, and you are bound by the terms of use and privacy policy applicable to such External Sites.

For complaints regarding this Privacy Policy, our Person in Charge of the Protection of Personal Information will investigate and inform the complainant of the procedure to be followed. If the complaint is justified, the specific issue will be resolved, and the complainant will be notified.

We are committed to responding promptly and accurately to all your questions and concerns regarding the privacy and security of your Personal Information.

ActuMates may, at its discretion, update, revise, modify, or supplement this Policy from time to time. If significant changes are made to the Policy, you will be notified when you log in and/or we will notify you in any other manner in accordance with applicable laws and regulations. This Policy and any related notices, if any, will be posted on our Platform. ActuMates asks its users to review the revised Policy before continuing to use its Platform.
